SOFTWARE REGISTRATION
We are currently surrounded by software, such as desktop programs, mobile applications (Apps), programs on smartwatches, smartphones, smart TVs, GPS, etc. In short, almost everything around us works through software.
Registering computer programs (software) with the INPI guarantees:
Greater legal security for its holder in case there is, for example, a lawsuit to prove authorship or ownership of the program;
Official definition of property rights and moral rights;
Protection with international scope in all 176 countries that are signatories to the Berne Convention;
Valid for 50 years, backed by the Copyright Law (Law 9.610/98) and the Software Law (Law 9.609/98).

Legal certainty
Software registration with the INPI (Brazilian National Institute of Industrial Property) is considered robust proof of software authorship. Even though this proof carries a presumption of relative authorship (proof to the contrary is admissible), in court, it is the other party that will have to prove that the authorship does not belong to the person listed in the registration.
Direito de Exploração
Em caso de falta de registro ou de contratos de cessão dos direitos patrimoniais, estes são do autor, ou seja, do programador pessoa física. O registro será uma prova do direito patrimonial ser da empresa ou do contratante do programador.
Obrigatoriedade em Licitações
Tenders involving software have been requiring its registration with the INPI (National Institute of Industrial Property) as a technical qualification for companies to participate in the bidding process. Software registration with the INPI will prevent disqualifications in tenders due to lack of qualification.
Government funding
O BNDES, por exemplo, considera o software registrado no INPI como uma das condições de enquadramento para que a empresa possa participar do programa de financiamento MPME Inovadora. Outros financiamentos já estão exigindo registro (Inova Mineral, FINEP).
Publicity of registrations at INPI
Neste caso, o desenvolvedor terá, por meio da RPI (Revista da Propriedade Intelectual), a publicidade de seu software para consulta por parte da sociedade. Podendo inclusive fazer um portfólio com todos os softwares que já tenha desenvolvido e registrado no INPI.
